Terms of Service

Acceptance of terms

By accessing archixdigital.com or using any Archix Digital service (including Archix CRM, Archix Board, and Archix OS) you agree to these terms. If you don't agree, don't use the services.

Services

Archix Digital provides web development, custom software, and SaaS products for small businesses. Specific deliverables, timelines, and payment terms for project work are defined in individual project proposals or statements of work, which take precedence over these general terms where they conflict.

Your account

If you create an account on any Archix product, you are responsible for maintaining the security of your login credentials and all activity that occurs under your account. Notify us immediately at info@archixdigital.com if you suspect unauthorized access.

Payment

  • Project work

    Payment schedules are defined per engagement: typically a deposit upfront and the remainder on delivery or at defined milestones.

  • Monthly retainers

    Billed at the start of each billing period. Cancel anytime with 30 days written notice. No refunds for the current billing period.

  • SaaS subscriptions

    Billed monthly or annually depending on plan. Cancellation takes effect at the end of the current billing period.

Ownership of work

For custom project work: upon receipt of final payment, you own the code, designs, and assets we built for you. We retain the right to display the project in our portfolio unless you request otherwise in writing. For SaaS products: you own your data. We own the software. Cancelling a subscription does not delete your data. We retain it for 30 days after cancellation to allow export.

Acceptable use

You agree not to use Archix services to:

  • Violate any applicable law or regulation

  • Transmit spam, malware, or harmful code

  • Attempt to gain unauthorized access to any system

  • Resell or sublicense Archix software without written permission

Availability and uptime

We aim for maximum uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for damages resulting from service interruptions outside our control.

Limitation of liability

To the extent permitted by law, Archix Digital's total liability for any claim arising out of these terms or use of our services shall not exceed the amount you paid us in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

Termination

Either party may terminate a service agreement with 30 days written notice. We reserve the right to suspend or terminate accounts that violate these terms without notice. Upon termination, your access ends and your data is retained for 30 days before permanent deletion.

Changes to these terms

We may update these terms periodically. Material changes will be noted by updating the date at the top of this page. Continued use of our services after changes constitutes acceptance.

Governing law

These terms are governed by the laws of the State of Louisiana, United States. Any disputes will be resolved in the courts of Louisiana.
